Privacy and Personal Data Processing Policy

Through this Privacy and Personal Data Processing Policy, Pacifica Continental and its Economic Group present to personal data holders the personal information we collect, why we collect it, and what we do with it, in addition to the measures adopted to protect this Personal Data.

BY ACCEPTING THIS PRIVACY POLICY AND ACCESSING OUR WEBSITE, THE USER DECLARES TO BE THE HOLDER OF THE PROVIDED PERSONAL DATA OR TO HAVE AUTHORIZATION TO PROVIDE THEM AND AGREES TO THESE TERMS ON THEIR OWN BEHALF OR ON BEHALF OF THE ACTUAL HOLDER, AND ARE SUBJECT TO THE CONDITIONS OF THIS PRIVACY POLICY.

I – INITIAL PROVISIONS

Pacifica Continental is part of an Economic Group, as a multinational recruitment company, whose ambition is to have a long-reaching impact on careers and businesses worldwide. Our headquarters are located in Brazil, but we have offices in several other countries, operating in 45 countries and more than 150 cities.

Definitions

For the purposes of this Privacy Policy, we will use the following terms:

“Pacifica Continental”: refers, in this Privacy Policy, to the company responsible for handling the personal data detailed here, it being understood that the present content encompasses the entire Economic Group that is part of it. “User(s)”: represents the Candidates and any other data holders who register on our Website or who send personal data through our Communication Channel. “Client”: represents any company to which we provide our Services and that registers on our Website and/or sends us information through our Communication Channel. “Candidate”: represents any natural person who registers on our Website to get in touch with our Clients. “Communication Channels”: represents any of the official communication channels of Pacifica, such as our Website, our application links for job vacancies announced on our official networks, LinkedIn, etc. “Accept or Acceptance”: represents the act of the User clicking on the box “I have read and accept the Privacy Policy” available on our Website. Such an act implies the User’s prior, express, and informed consent regarding everything set forth in this Privacy Policy, especially, the request and granting of authorization for the collection, use, storage, and transfer of databases composed of Personal Data, among other information. “Personal Data”: represents all and any data collected from Users related to an identified or identifiable natural person. “Services”: represents the services promoted by Pacifica Continental to Clients in Recruitment & Selection, Market Mapping, Internship Agency, Temporary, Outsourced, Independent Contractor, or Assessment Projects.

II- GENERAL INFORMATION

When the Candidate registers on our Website, they authorize the collection, access, use, storage, and transfer of their Personal Data by Pacifica Continental and its economic group, giving their free Acceptance to the terms stipulated here.

Similarly, Personal Data from natural persons related to our Clients may be collected if such information is sent and made available to us through our Communication Channels. The sending of said information tacitly confers free Acceptance to the terms stipulated here.

If the User, or any other data holder, does not agree to consent to this Privacy Policy or our Terms of Use, they must immediately stop using our services. Disagreement with this Privacy Policy or the Terms of Use will result in the Candidate’s inability to register on our Website and the termination of services provided by Pacifica Continental to the Client, considering that all collected data has a specific and indispensable purpose for the use of our Website and the availability of our services.

Personal Data is collected when entered or submitted voluntarily by the Candidate when accessing our Website or when sending information through our Communication Channels. Data can also be collected through third-party means, provided they are legal, such as public sources made available by the State.

Pacifica Continental is the sole and exclusive responsible for providing the Services, as well as for registering Users on the Website, being responsible for protecting the data it maintains and any way treated, according to its own Personal Data protection policy.

III – COLLECTED PERSONAL DATA

What data do we collect?

If you are a Candidate, you must provide personal data at the time of registration on our Website, which will be retained only for the purposes listed in this Policy, under secrecy, in a controlled and secure environment, using systems, policies, and technology to protect the following information:

  • Name;
  • Email;
  • Phone;
  • Address;
  • Academic information;
  • Links to social networks, relationship networks, or blogs of the candidate;
  • Data related to inclusive vacancies and for People with Disabilities (PwD); and
  • Information about your professional life.

In addition to the Personal Data requested at the time of registration on our Website, additional personal information may be collected through the upload of your resume — as addressed in a subsequent section more specifically —, information sent through our Communication Channels, by personal interviews or conducted by telephone, or even information published on LinkedIn and other related sites.

 

Additionally, if you are our Client, the following personal information of the natural person responsible for communication with Pacifica Continental may be collected through our Communication Channel:

  • Name;
  • Email; and
  • Country of location.

Besides the above data, we may collect additional personal information through the content of the message sent to us via our Communication Channels, as long as voluntarily provided by the data subject.

Users are not required to provide any personal information to Pacifica Continental. However, any information provided will be considered as voluntarily given and may be processed and shared under the terms of this Privacy and Personal Data Processing Policy. Users should be aware that the absence of certain information may limit our ability to provide our Services and may even result in the inability to execute them.

Some data may be automatically collected when the User accesses our Website, such as IP address, device type, unique identification numbers, browser type, broad geographic location (e.g., country or city level location), time spent on our Website, information from other pages accessed, and other information necessary to profile the User and improve our Services. For more details, please read the “Cookies” section in Section V of this Privacy Policy.

Users who request the deletion of their information will have their request honored by Pacifica Continental, and their Personal Data will be permanently deleted from our database, in accordance with applicable legislation.

Resume

The user may choose to send their Resume to Pacifica Continental through a job vacancy announcement, by email, or directly to one of our recruiters. All information contained in the resume file will be stored in our databases, as well as the document itself, for use in current and, if chosen by the user, future recruitment processes.

Our recruiters may access your resume at any time, and it may be sent to our client companies during a recruitment and selection process.

Users may request the deletion of their resume and information by simply contacting Pacifica Continental and requesting such action.

In addition to the information contained in your resume, if the user uses a social network platform to apply — such as LinkedIn —, it is possible that data from their profile and data requested by the platform for the application are also stored in our database. Other information provided to us by the data subject during our process, such as the results of tests and Assessments, will also be stored and may be shared with our clients during recruitment. In any case, we emphasize our full commitment to protecting them with all applicable tools.

Test Results

Another type of data collected by Pacifica Continental is the results of tests and Assessments taken by candidates, which are analyzed to find the best job opportunity relative to the specificity of each User’s profile. Such information is handled by our recruiters and shared with our clients, who will conduct their own professional profile analysis. Finally, test results are stored in our databases for future opportunities that the user may be compatible with, but if the user wishes to have them deleted, they must contact Pacifica Continental to request it.

Job Alerts

It is possible to subscribe to receive job alerts from Pacifica Continental, whether through social networks like LinkedIn or through our own website. In the latter case, the User will receive newsletters with information about the company, open positions, and direct marketing campaigns. At the time of subscription, Pacifica Continental will collect your email data and any other information requested on the social networks where the user registers.

IV – PURPOSE

The Personal Data collected from Users may be used for the following purposes:

  • Enable your participation in job selection processes;
  • Include your data in the talent pool of the companies in whose selection processes you have enrolled;
  • Contact you regarding the progress of the selection process you are participating in or to inform you about new processes that may be of your interest, including sending job alerts;
  • Properly respond to your requests and inquiries;
  • Share the Personal Data of Candidates with our Clients;
  • Properly identify you on our Website;
  • Develop market analysis;
  • Conduct statistics, studies, surveys, and research relevant to the provision of our Services;
  • Check for any unlawful act committed by the User in the public sphere, criminal background, wanted lists, and any other necessary checks to ensure that such a candidate does not harm the image of Pacifica Continental when considered for a professional position;
  • Optionally, send the User information such as reports, promotions, surveys, invitations to events, and general information that we find interesting (in each case, according to your profile);
  • Improve the use and browsing experience on our Website;
  • Protect rights and obligations related to the use of our Website and our Services;
  • Collaborate and/or comply with a judicial order or request by an administrative authority;
  • Exercise and defend any rights of Pacifica Continental, at its discretion, including in the context of judicial or administrative processes;
  • Provide them to bodies, authorities, and other public entities, as well as to natural or legal persons of a private nature, in compliance with a legal obligation or court order;
  • Share the Personal Data collected using cookie technology to offer a more appropriate experience to our USERS; and
  • Share and transfer the Personal Data collected to business partners, for the specific purpose of providing our Services or preventing the occurrence of fraud and associated risks.

The use of Personal Data may eventually cover other purposes beyond those set forth above, provided that it is duly authorized by prior and express consent of the USER.

Pacifica Continental may send informational or advertising messages to the USER about products, services, promotions, news, and others that are customized based on the collected information, exclusively for the unique purpose of Pacifica Continental.

Access to Data

User data is processed and stored in our databases by individuals authorized by Pacifica Continental, as well as its Economic Group. They are shared internally among recruiters for selection processes, companies that are part of our group, clients interested in your application, IT teams, and any other areas responsible for your payroll, tax deductions from your salary, etc.

Sensitive Data

Some of the Personal Data we may collect about Candidates (under appropriate circumstances and in accordance with applicable legislation) fall under the concept of “sensitive data.” These are information about ethnic origin, gender, health, sexual orientation, religion, or others.

This Personal Data may be disclosed to Clients when contractually required or when the Client specifically requests this information to allow them to comply with their own recruitment processes, always in accordance with legal standards. It is also emphasized that the inclusion of this information is not mandatory and will always be optional for the candidate.

It is important to highlight that Pacifica Continental does not discriminate against any of the Sensitive Data collected and does not work on selection processes that contain any prejudice against any group. We are a company grounded in diversity, and therefore, all our candidates receive equal treatment in our process regarding this aspect. The sensitive data collected may occasionally be used to monitor the diversity content of our databases and selections, always aiming for greater equity.

V – PROCESSING OF PERSONAL DATA

The database formed through the collection of Users’ Personal Data is our property and responsibility, and its use, access, and sharing, when necessary, will be done within the limits and purposes of the business of Pacifica Continental, as well as its Economic Group, in accordance with this Privacy Policy.

Pacifica Continental uses physical and electronic systems, policies, procedures, and technology that provide security for Personal Data, in compliance with applicable legislation.

However, considering that no security system is infallible, Pacifica Continental disclaims any responsibility for possible damages and/or losses resulting from failures, viruses, or invasions of Pacifica Continental’s database, except in cases where fault or negligence of Pacifica Continental itself is proven.

The User is aware that the access password to the Website is personal and non-transferable and is responsible for keeping it confidential, as well as for any damages resulting from the misuse of the password by third parties, including regarding the unauthorized access and use of their Personal Data. The access password should not be shared with third parties, in which case the User will be responsible for all actions taken by third parties due to the sharing of the access password.

Internally, the Personal Data of our Users is accessed only by professionals duly authorized by Pacifica Continental, through access control, respecting the principles of proportionality, necessity, and relevance for the objectives of Pacifica Continental, in addition to the commitment to confidentiality and privacy preservation under the terms of this Privacy Policy.

The Personal Data obtained from our Users may be stored on our own servers or those of a third party contracted for this purpose, located in Brazil and other countries, and may also be stored using cloud computing technology and/or others that may arise in the future. In any case, Pacifica Continental adopts all necessary measures to ensure the security of Personal Data and the privacy of Users.

Due to the continuous nature of our Services, the Personal Data collected will be stored in our database until the User requests its definitive exclusion or when the reasons for its purpose cease, at the discretion of Pacifica Continental.

The deletion of Candidates’ registration on our Website means only that the registration will be deactivated and will not be shared with our Clients or third parties from the date of registration deletion. However, Pacifica Continental informs that, as data transfer may have occurred before the deletion date, to ensure the effective deletion of your personal data in our database and that of our Clients or third parties contracted, the Candidate should contact us through our Communication Channel ([email protected]).

Cookies

Our website uses cookies and similar technologies to store and manage your browsing preferences, enable content, and collect site analysis and usage data. The use of these technologies is common on websites and platforms in general, consisting of a small text file placed on your device or browser, which allows your identification as a user and the device used, as well as to collect navigation information.

The cookies we use may perform different functions.   • Our Clients, when the User is a Candidate;
  • Companies in our Economic Group (a current list of our group companies is available below);
  • Any competent police, regulatory, or governmental body, only if requested by an official agent of the jurisdiction or when necessary to defend the rights of Pacifica Continental;
  • Potential buyers or investors (and their agents and consultants) in the event of a proposal to acquire/invest in our business or part of it; and
  • Third parties contracted to perform services on our behalf, always with due data protection.

Regarding the International Transfer of Personal Data

Your personal information may be transferred, stored, and processed in countries other than the country where you reside.

Our group companies and service providers operate worldwide. This means that when we collect your personal information, we may process it in any of the countries where our companies and service providers are located.

However, we always adopt adequate safeguards to require that your personal information remains protected in accordance with this Privacy Policy. It is important to note that Pacifica Continental only engages with suppliers, clients, among others, that adopt security measures and good practices compatible with the level of protection established by Brazilian legislation, as regulated by the National Data Protection Authority (ANPD). In the absence of specific regulation, we commit to working only with companies that adhere to other data protection norms, such as the European GDPR or the American CCPA, or with companies whose contracts contain specific clauses for transfers with Pacifica Continental, as well as restricting the transfer only to what is strictly necessary to fulfill the obligations assumed with you.

Regarding Users’ Rights

At any time, you can change your settings or exercise the rights provided here:

  • Right to confirmation: you can confirm whether Pacifica Continental processes any of your personal data.
  • Right of access: you can check the details of your data, as well as obtain copies of such information, through the candidate panel.
  • Right to correction: you have full access to the data in your resume, being able to change, correct, or remove any personal data that is incomplete, inaccurate, or outdated.
  • Right to anonymization, blocking, or elimination: you may request the anonymization, blocking, or elimination of data that is unnecessary, excessive, or processed in non-compliance with the purposes set out in this Policy, observing, for this purpose, other norms of the legal system. In these cases, if there is anonymization or blocking of data that impairs the active maintenance of your resume, your participation in selection processes will be impaired or prevented.
  • Right to information: you can request information about which types of companies we share your data with, as well as be informed of the consequences if you choose not to consent to the collection and processing of your personal data, when necessary.
  • Right to refuse marketing: at any time, you can request the cancellation of receiving materials through the link provided in the marketing email sent.
  • Right to revoke consent: when the legal basis for data processing is consent, you can cancel this consent previously given to us. It is important for you to know that the cancellation will not affect the use or sharing of data carried out before the request to revoke consent.
  • Right to opposition to future treatments for other legal bases: you may request the deletion of your resume from Pacifica Continental and the interruption of any other service provided by Pacifica Continental. However, it is important for you to know that some data may be maintained for legal purposes and that the deletion may not have effects for the controlling companies that obtained access to your resume through Pacifica Continental before your request. It is worth remembering that deactivating the resume prevents your participation and application for new vacancies, and this is irreversible.

VI – UPDATES TO THIS PRIVACY POLICY

To improve our Services, this Privacy Policy may be updated periodically. In any case, you must grant new consent to the updated Privacy Policy to continue using our Services.
